Welcome to AlertMe Live. These Terms of Service ("Terms") govern your access to and use of the AlertMe Livewebsites, mobile applications, and related services (collectively, the "Service"). By creating an account, downloading the app, accessing the website, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Who We Are

AlertMe Liveis a personal safety communication service that helps a user notify selected trusted contacts when the user starts a safety timer or activates a live alert. Depending on product settings and channel availability, those notifications may be sent by SMS, email, WhatsApp, or other supported communication channels, and may include the user's location, alert status, map link, and nearby context resources. The Service is offered free of charge and in the public interest.

2. Important Service Limits

AlertMe Live is not:

  • 911
  • a police dispatch service
  • a medical provider
  • a law firm or legal referral service
  • a guaranteed emergency-response service
  • a substitute for calling local emergency services when immediate help is needed

AlertMe Live is provided on a best-effort basis and depends on factors outside our control, including device state, permissions, operating system behavior, background execution limits, battery, network conditions, carrier filtering, email deliverability, third-party platform outages, public-data quality, mapping accuracy, and recipient device state. Notifications, location updates, and jurisdiction/resource matches may be incomplete, delayed, misrouted, or unavailable.

If you are in immediate danger, call 911 or your local emergency number immediately. AlertMe Live does not contact authorities on your behalf.

3. Eligibility

You may use the Service only if:

  • you can form a binding contract under applicable law;
  • your use of the Service is not prohibited by applicable law;
  • the information you provide is accurate and current; and
  • you use the Service only for lawful, personal, and authorized purposes.

If local law requires parental or guardian consent for a user below a certain age, use is permitted only with that consent and only to the extent allowed by law.

4. Your Account

You are responsible for:

  • maintaining control over your device and account credentials;
  • using accurate and current profile information;
  • keeping your contact information up to date;
  • promptly reviewing alerts, settings, and contact details for accuracy.

You are responsible for activity that occurs through your account except to the extent caused by our own security failure.

Sign-in methods include password-based authentication, and may include supported social sign-on methods such as Google Sign-In and Apple Sign-In.

We may require verification steps, security checks, or account confirmations before certain account changes are accepted.

5. Trusted Contacts and Consent

You may add trusted contacts to receive notifications on your behalf. By adding a contact, you represent and warrant that:

  • you have the right to provide that person's contact information;
  • you have that person's permission, where required, to receive automated or app-generated notifications from AlertMe Liveon your behalf;
  • the information you provide for that contact is accurate; and
  • you will not use the Service to harass, intimidate, impersonate, threaten, surveil, stalk, or deceive anyone.

A trusted contact's receipt of a message does not create any legal duty on that contact's part, and AlertMe Live is not responsible for what a contact does or fails to do after receiving a message.

6. What the Service May Send

When you start a timer or activate a live alert, the Service may send one or more notifications to your trusted contacts. Depending on settings, channel availability, and product configuration, those notifications may include:

  • your name or account identifier;
  • your alert status;
  • a map or map link;
  • your live or recent location during an active timer or alert;
  • repeated updates during the alert period;
  • nearby law-enforcement, hospital, legal-aid, or support-resource information for context;
  • a notice that the alert has stopped, timed out, been canceled, or otherwise changed state.

Nearby station, hospital, legal-aid, and support-resource information is informational only. It may be incomplete, delayed, inaccurate, out of date, operationally irrelevant, outside true jurisdiction, or otherwise unsuitable for immediate reliance. Public datasets can change without notice. Do not rely on these resources for immediate life-safety decisions.

Station and resource information is derived from public and third-party sources and may not reflect current boundaries, closures, or operational status.

7. No Emergency Response, Medical Advice, or Legal Advice

AlertMe Live is a communication tool. It does not provide emergency response, police response, medical advice, medical triage, legal advice, legal representation, or an attorney-client relationship.

Any legal-aid or support-resource links are informational only and do not constitute endorsement, screening, guaranteed availability, or professional advice.

8. Best-Effort Basis; No Guarantee of Delivery or Outcome

The Service is provided on a best-effort basis. Notifications, links, location updates, matching logic, maps, public-data lookups, timer behavior, and recipient delivery all depend on systems and conditions outside our control. Results may be delayed, incomplete, inaccurate, duplicated, filtered, unavailable, or never received.

We do not guarantee:

  • uptime;
  • alert delivery;
  • timing of any message;
  • location accuracy;
  • map accuracy;
  • resource-match accuracy;
  • contact response;
  • any protective, legal, medical, or safety outcome.

9. User Responsibilities

You agree that you will:

  • use the Service only for lawful purposes;
  • keep profile and contact information accurate;
  • review your settings and alerts for correctness;
  • obtain any permissions needed from people whose information you submit;
  • call emergency services directly if immediate official response is needed;
  • comply with carrier, platform, and app-store rules that apply to your use.

You agree that you will not:

  • misuse the Service to send false alerts or misleading notifications;
  • use the Service for stalking, coercion, domestic abuse, harassment, retaliation, or surveillance of others;
  • interfere with or disrupt the Service;
  • attempt to access systems or data you are not authorized to access;
  • reverse engineer the Service except where applicable law expressly permits it;
  • use bots, scripts, or automated means to abuse or overload the Service;
  • upload malware or exploit vulnerabilities;
  • use the Service in any way that violates law, court order, protective order, or others' rights.

10. Suspension and Termination

We may suspend, restrict, or terminate access to the Service at any time, with or without notice, if we reasonably believe:

  • you violated these Terms;
  • your use creates legal, security, abuse, or operational risk;
  • we are required to do so by law or by a service provider/platform;
  • continued access is no longer commercially or operationally feasible.

You may stop using the Service at any time. Account deletion and data deletion are addressed in the Privacy Policy.

11. Software, App Stores, and Device Platforms

If you download the mobile app through Apple's App Store or Google Play, your use is also subject to the applicable store's terms and policies. Apple and Google are not responsible for the Service itself. To the extent required by those platforms, those companies are third-party beneficiaries of these Terms solely in relation to the mobile app license granted to you.

We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the app and Service for personal, lawful use in accordance with these Terms.

12. Intellectual Property

The Service, including its software, design, text, graphics, logos, trademarks, content, and underlying technology, is owned by AlertMe Live or its licensors and is protected by intellectual property law. Except for the limited license above, no rights are granted to you.

If you provide feedback, suggestions, or ideas, we may use them without restriction or compensation.

13. Privacy

Your use of the Service is also governed by the AlertMe Live Privacy Policy. By using the Service, you acknowledge that we process data as described there, including account details, trusted-contact data, alert-session data, and live location while a timer or alert is active.

14. Third-Party Services and Content

The Service relies on third-party infrastructure, messaging, hosting, mapping, and other providers to operate. We are not responsible for third-party acts, omissions, outages, filtering, delays, data inaccuracies, or policy changes. Links to third-party resources do not mean we endorse them.

15. Security

We use encryption in transit (HTTPS/TLS) for web and API traffic and apply encryption controls for trusted-contact channel data at rest. No system can guarantee absolute security.

16. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, OR THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

WITHOUT LIMITING THE FOREGOING, ALERTME LIVE DOES NOT WARRANT THAT:

  • ALERTS WILL BE SENT OR RECEIVED;
  • CONTACTS WILL RESPOND;
  • LOCATION DATA WILL BE ACCURATE OR CURRENT;
  • PUBLIC RESOURCE INFORMATION WILL BE CURRENT OR CORRECT;
  • THE SERVICE WILL PREVENT HARM, REDUCE HARM, OR PRODUCE ANY PARTICULAR OUTCOME.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALERTME LIVE, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, OR FOR PERSONAL INJURY, EMOTIONAL DISTRESS, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • $50 USD, OR
  • THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Because the Service is currently offered free, in many cases that amount may be zero.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

18. Indemnity

You agree to defend, indemnify, and hold harmless AlertMe Liveand its affiliates, licensors, and service providers from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your misuse of the Service;
  • your violation of these Terms;
  • your violation of law or another person's rights;
  • information you submit about contacts or third parties;
  • false, abusive, or unauthorized alerts you initiate.

19. Changes to the Service

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service, website, or by other reasonable means. The updated Terms become effective on the stated effective date. Your continued use after the effective date means you accept the revised Terms.

21. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction and venue there.

22. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.
